Update from the HPLVW Community Association Board of Directors – Hearing Summary. I do agree with Mrs. Gros’ assessment that the hearing went well. The rest of what she said is a spin to try and make it out that the judge is going to rule in her favor. I personally do not believe so.
I was on the call and have a different opinion of what transpired. To start the judge didn’t grant her a transcriptionist, he actually informed us that his court recorder already does that and if you want a copy of the transcript you can contact him to purchase one and he denied her request to have us pay for half of the cost.
In regard to her request to vacate his order allowing us to make emergency repairs, the judge did say, that it was probably a moot point anyway but that he believes it was the right call either way to allow us to make repairs and actually said, “Doing something is better than not doing anything”.
Keith is right, the judge didn’t ask Mrs Gros about how we have been allowed to get away with it for all these years.
During our lawyer’s statement he did reference that not only is the case due to be dismissed because of Mrs Gros’ lack of standing but that even if you accept Mrs Gros argument that we have not followed the corporate documents that it would be dismissed because we have been operating this way for over 30 years and would be considered a “defacto” corporation.
During her response, Mrs Gros attempted to invoke the CCRs and say that her rite to use the lake and to administer the corporation has been blocked by us individually and that we have badgered and bullied her. The judge did correct her and told her that the covenants give her “the rite to vote not to administer. ”
The judge did take it under consideration and said that we should get a ruling either next week or the week after. Based on the hearing, we are optimistic and are hopeful that we will have a positive outcome.
